Where one-to-one consent stands

In December 2023 the FCC adopted a one-to-one consent rule under the Telephone Consumer Protection Act (TCPA). It targeted a long-standing industry practice: a consumer checking one box to give consent for calls or texts from an entire list of unnamed marketing partners. Under the rule, consent would have to be given to one identified seller at a time, for a clearly and conspicuously disclosed subject matter.

The rule was scheduled to take effect on January 27, 2025, but on January 24, 2025 the Eleventh Circuit vacated it in Insurance Marketing Coalition Ltd. v. FCC, so it never became binding law. The practice it targeted has not gone away as a legal matter - but the market has largely moved anyway. Many buyers, networks, and carriers now require one-to-one consent contractually, and leads that carry it command more trust and fewer disputes. Capturing consent that names the single company a consumer will hear from remains the safest way to generate and sell leads.

How PingPickPost does it

  • Post - the full lead is posted only to the buyer the consumer picked. No other buyer on the ping receives the lead or the consumer's contact information.

The pick value itself can be captured dynamically from the consumer's selection or hardcoded for a single-buyer campaign, so the same mechanism covers both a multi-buyer marketplace flow and a simpler exclusive-lead setup.
